In the past few years, digitalization and technological advancements have led to an increase in the crime of blackmail by making videos and photos. Video calling applications like WhatsApp, Facebook, Instagram etc. have given a big boost to cyber crimes. These video calling features put users at risk of being video recorded. Crimes such as cyberstalking, which often involve pornography and sextortion, have become a major cause of blackmail.

Blackmail is an offense under the Act
There are several provisions in the law under which blackmailing through video is a punishable offence. Blackmailing is a form of criminal intimidation. If someone is blackmailing you through video to harm your honor or property, you can file a complaint under Section 503 of the IPC. Often criminals use coercion or demand to blackmail the victim via video, which is illegal. This is a form of extortion, which also falls under Section 384 of the IPC. Under which the victim can file a case. Also threatening to expose obscene photographs to the victim through electronic media is also an offense under Section 292 of the IPC.

Offense under the IT Act
Under Section 66E of the IT Act 2000, an offense can be booked for violating a person’s privacy by capturing a video or broadcasting a photograph of him without his consent. Similarly, a blackmailer can be prosecuted under Section 67 of the IT Act 2000 if his video is broadcast to defame a person. Section 67A is a legal weapon against blackmailers. What to do if someone is blackmailing you?
Do not listen to any of the blackmailer’s words or comply with the blackmailer’s demands to intimidate you. By doing this, your problems will increase and the blackmailer will achieve his goal.
